U.S. TRADE REPRESENTATIVE'S "WATCH LISTS"
FOR INTELLECTUAL PROPERTY PROTECTION

The United States Trade Representative (USTR) regularly publishes a "Special 301" list (Trade Act of 1974) of foreign countries that deny adequate and effective protection of intellectual property rights or fair and equitable market access for U.S. persons or businesses that rely on such protection.  The USTR established a list of "Priority Foreign Countries" that: (1) have the most "onerous and egregious acts, policies and practices" which have the most adverse impact on U.S. products (Special 301 Provisions - "Priority Watch List"); and (2) are not engaged in "good faith negotiations" or making significant progress in negotiations to address the problems (Special 301 Provisions - "Watch List"). 

Upon identification of these countries, the USTR will then decide within 30 days whether to initiate an investigation of the countries' intellectual property laws and policies (or lack thereof) and will then issue a report on the problems with each country and what U.S. persons should be aware of.  Countries are grouped into categories based on the severity of the problems associated with intellectual property rights protection. A summary of the  2007 Special 301 Report follows and you can view the entire report (as well as previous reports) on the USTR website at http://www.ustr.gov/Trade_Sectors/Intellectual_Property/Section_Index.html.

Paraguay - Paraguay continues to have problems with both internal and border enforcement of copyright and trademark protection, and the U.S. continues to monitor the situation.
