Defense Trade Security Initiative: Multiple Destination Licenses

The issuance of Multiple Destination Marketing Licenses is aimed at promoting and encouraging commercial cooperative cross-border defense teaming by assuring industry reasonable sales. Foreign firms are often reluctant to enter into cooperative defense projects with U.S. defense firms because they do not believe that the U.S. government (USG) will authorize the sale and distribution of their joint product to third party destination countries.

The USG is committed to promoting transnational defense cooperation and encourages U.S. defense firms to use Multiple Destination Marketing Licenses, which establish a pre-approved sales territory. More specifically, when the USG approves an agreement - e.g. manufacturing or technical assistance agreement - between a U.S. and a NATO/Japan/Australia defense firms, the USG is also prepared to authorize a marketing approval list of third country destinations to the agreement partners by issuing a Multiple Destination Marketing License. In establishing a pre-approved sales territory, a Multiple Destination Marketing License creates a presumption that a DSP-5 export license will be granted for U.S. origin goods incorporated into foreign products that are sold to the pre-approved sales territory. Note, that a Multiple Destination Marketing License does not eliminate the need to obtain a DSP-5 export license for a specific sale of a U.S. origin product, but it does indicate that positive consideration will be given to DSP-5 export licenses for countries for which marketing has been pre-approved in a Multiple Destination Marketing License.

In general, the USG maintains a general principle of approval for DSP-5 export licenses for U.S. origin goods that are incorporated into foreign products that are manufactured within NATO/Japan/Australia for sale within NATO/Japan/Australia realm. Note, however, that destination countries in Multiple Destination Marketing Licenses are not limited to the NATO/Japan/Australia realm. Provided below, is a list of countries arranged geographically into regions by the six Department of State Bureaus. The listing is compiled in order to assist registered companies in preparation of agreements. Export license form DSP-5 should be used in applying for a Multiple Destination Marketing License. Prospective exporters should apply for a DSP-5 for each region they plan to market their products in. The Department of State suggests that applications be submitted for multiple destinations when the countries share common requirements and foreign policy considerations. License requests may take longer to approve when these factors are not common to the agreement.
